Does anyone have experience with visa for international searchers?

The partner I am planning to work with is Canadian, and currently working in the US on a TN visa, and we were curious if anyone has experience on how to maintain that visa with him working for the search fund full time or if you need to switch to H-1B. We are not asking for legal advice as we know a lawyer will need to be consulted, but any anecdotal stories or experience you can share would be helpful.

Technically, a TN Visa would suffice and can be renewed indefinitely. However, in reality it is much more subjective and can be affected by what the immigration officials decide is a reasonable amount of time for the applicant to complete their intended work (the search process). As a Canadian, I know a number of people who have had major issues with immigrating to the US for similar reasons/purposes and I also ran into problems in my previous life as a Restructuring professional working on cross-border deals with TN Visas.

I would definitely recommend speaking with a lawyer.

Hi, Michael. I handle E2 visas specifically, which is what an investor would need. Of course, he can always keep the TN as long as he keeps the TN job. The trick at the moment is dealing with the U.S. consulate in Toronto. Hopefully once the employees get the vaccine, things will be back to normal. That said, I deal with Canadian investors frequently, and I currently have a Canadian client on TN who will be switching to E2 later in January.
