Is it inappropriate to use the same LLC name as the seller?

As long as they're registered in different states - or since I'm using bank financing will that be too confusing? Thanks in advance for the input!

You will need rights in the name, either through the acquisition or through some other means, or it might be considered trademark infringement. Create an LLC with a different name in advance of the transaction, mandate the seller give up the name post-sale, and change your existing LLC’s name post-sale (takes about a day or two once the seller files the change with the state). Your attorney should know the process well.
