Wife's Equity Payout Protected from PG

Hi All, My wife is about to come into some significant money. I want to make sure when I sign a PG, that money is protected. My house, liquid assets, etc. are fair game, but this is a significant amount of money I want to make sure is not touched. Anyone have experience with this or have words of advice to offer? I’d definitely speak with an asset protection/estate planning attorney before signing the PG or moving any money around. A lot will depend on how the funds are received, whose name they’re held in, whether they’re commingled, and your state’s marital property laws. Don't just rely on Searchfunder comments here. Speak with an actual professional.

On the financing side -- SBA 7(a) requires a personal guarantee from any owner with 20%+ equity, and that guarantee generally reaches the guarantor's personal assets, but whether your wife's incoming funds are exposed usually comes down to how they're titled, whether they stay separate under your state's marital property law, and whether they get commingled with joint accounts or the deal itself. One thing worth knowing from the lender side: even funds you keep untouched will still show up on your SBA Form 413 personal financial statement, so plan for that disclosure regardless of how you structure ownership. Definitely worth an asset protection attorney as others have said, but happy to walk through how lenders typically view this if useful.
